ARTICLE IV
ISSUE OF BONDS
The 2013 Series C Bonds, 2013 Series D Bonds and 2013 Series E Bonds in the aggregate principal amount of $170,000,000
may be executed, authenticated and delivered from time to time as permitted by the provisions of the Indenture, including with respect
to exchange and replacement of bonds.
ARTICLE V
THE TRUSTEE
The Trustee shall not be responsible in any manner whatsoever for or in respect of the validity or sufficiency of this
Supplemental Indenture or the due execution hereof by the Company, or for or in respect of the recitals and statements contained
herein, all of which recitals and statements are made solely by the Company.
Except as herein otherwise provided, no duties, responsibilities or liabilities are assumed, or shall be construed to be assumed, by
the Trustee by reason of this Supplemental Indenture other than as set forth in the Indenture and this Supplemental Indenture is
executed and accepted on behalf of the Trustee, subject to all the terms and conditions set forth in the Indenture, as fully to all intents as
if the same were herein set forth at length.
ARTICLE VI
RECORDING AND FILING OF SUPPLEMENTAL INDENTURE
DATED AS OF DECEMBER 1, 2012
Pursuant to the terms and provisions of the Original Indenture, a Supplemental Indenture dated as of December 1, 2012
providing for the terms of Collateral Bonds to be issued thereunder designated as 2012 Series D Mortgage Bonds has heretofore been
entered into between the Company and the Trustee and has been filed in the Office of the Secretary of State of Michigan as a financing
statement on December 11 2012 (Filing No. 2012171682-7) and has been recorded as a real estate mortgage in the offices of the
respective Register of Deeds of certain counties in the State of Michigan, as follows:
