filing a written application for review with the Committee. Following such request for review, the Committee shall fully and fairly
review the decision denying the claim. Prior to the decision of the Committee, the Claimant shall be given an opportunity to review
pertinent documents and receive copies of them, free of charge, and submit issues and comments in writing. The review will take into
account all comments, documents, records, and other information submitted by the Claimant relating to the claim, without regard to
whether such information was submitted or considered in the initial benefit determination.
15.4 Decision on Review. The decision on review of a claim denied in whole or in part by the Plan Administrator shall
be made in the following manner:
15.4.1 Notification to Claimant of Decision. Within 60 days following receipt by the Committee of the request for
review, or within 120 days if special circumstances require an extension of time, the Committee shall notify the Claimant in
writing of its decision with regard to the claim. If special circumstances require an extension of time, written notice of the
extension shall be furnished to the Claimant prior to the commencement of the extension.
15.4.2 Format and Content of Decision. The decision on review of a claim that is denied in whole or in part shall set
forth: (i) the specific reasons or reasons for the adverse determination; (ii) specific reference to pertinent Plan provisions on
which the adverse determination is based; (iii) a statement that the Claimant is entitled to receive, upon request and free of
charge, reasonable access to, and copies of, all documents, records, and other information relevant to the Claimant’s claim for
benefits; and (iv) a statement describing any voluntary appeal procedures offered by the Plan and the Claimant’s right to
obtain the information about such procedures, as well as a statement of the Claimant’s right to bring an action under ERISA
section 502(a).
15.4.3 Effect of Decision. The decision of the Committee shall be final and conclusive.
15.5 Action by Authorized Representative of Claimant. All actions set forth in this Article XV to be taken by the
Claimant may be taken by a representative of the Claimant duly authorized by him to act on his behalf on such matters. The Plan
